Terms of Service

1. Acceptance

By creating an account at https://inxy.ai or using any Inxy.ai service, you agree to these Terms of Service. If you don't agree, don't use the service.

2. The service

Inxy.ai is a SaaS platform that helps Shopify merchants and SaaS publishers analyze and improve their organic search performance (SEO, AEO, GEO, LLMO). The service includes dashboards, recommendations, AI content generation, and integrations with Google Search Console, Google Analytics, Shopify, and Stripe.

3. Your account

• You're responsible for keeping your login credentials secure.
• You may not share your account or transfer it without our written consent.
• You must be at least 16 years old (18+ in jurisdictions where 16 doesn't suffice for contract).
• You're responsible for any activity under your account.

4. Plans and billing

4.1 Subscriptions

Plans are billed monthly via Stripe. Each plan includes a monthly credit allotment used to power AI workloads (content generation, audits, etc.). Unused subscription credits do not roll over.

4.2 One-time top-ups

Optional credit top-up packs supplement your subscription and never expire. Top-ups are non-refundable except as described in §4.5.

4.3 Plan changes

You can upgrade, downgrade, or cancel anytime. Upgrades take effect immediately with prorated charges; downgrades and cancellations take effect at the end of the current billing period.

4.4 Auto-renewal

Subscriptions auto-renew until cancelled. We email you 7 days before each renewal. Cancel via Settings → Billing.

4.5 Refunds

We offer a 14-day refund window for first-time subscriptions if you've used less than 25% of your monthly credit allotment. Email support@inxy.ai to request. Top-ups and renewals are not refundable.

5. Acceptable use

You agree not to:

• Use Inxy.ai to generate spam, plagiarize, or violate any third party's intellectual property.
• Reverse-engineer, scrape, or attempt to circumvent rate limits.
• Use the service to compete with Inxy.ai (e.g. scrape benchmarks for a derivative product).
• Connect platforms (Shopify, GSC, GA4) you don't have authorization to read.
• Generate content that violates Google's, OpenAI's, or other model providers' usage policies.

Violation may result in suspension, termination, and forfeiture of unused credits.

6. Content and data ownership

• Your data stays yours: store data, generated content, and any output from the service is owned by you.
• License to operate: you grant us a limited license to process your data to provide the service.
• Anonymized aggregates: as described in our Privacy Policy §5, we may compute cohort-level benchmarks from anonymized data. You can opt out anytime.
• AI-generated content: AI output may include common phrasings. You're responsible for reviewing AI output before publishing it.

7. Third-party services

Inxy.ai integrates with Shopify, Google Search Console, Google Analytics 4, Stripe, and AI model providers (Anthropic, OpenAI, DeepSeek, and others). Their respective terms apply to data they hold; we are not responsible for their availability or pricing.

8. Service availability

We aim for high uptime but do not guarantee uninterrupted service. We may perform maintenance, ship updates, or experience outages. Subscription credits do not extend to cover outages unless agreed in a separate SLA.

9. Termination

• By you: cancel anytime in Settings → Billing.
• By us: we may terminate or suspend for breach of §5, non-payment, or as required by law. We will provide notice except in cases of fraud or security risk.
• On termination, you have 30 days to export your data via Settings → Account before deletion.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT AI-GENERATED CONTENT WILL RANK, CONVERT, OR BE FREE OF ERRORS. SEO RESULTS DEPEND ON FACTORS BEYOND OUR CONTROL (GOOGLE ALGORITHM CHANGES, MARKET COMPETITION, CONTENT QUALITY).

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (LOST PROFITS, LOST DATA, LOST SEARCH RANKINGS).

12. Changes to these terms

We may update these terms; material changes will be emailed 30 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing law

These terms are governed by the law of the jurisdiction where Inxy.ai is incorporated. Disputes will be resolved in the courts of that jurisdiction.
